Please read these terms and conditions carefully before using the Eshwara platform. These terms govern your access, co-ownership portfolio, and relationship with Eshwara.

1. Acceptance of Terms

By accessing, registering, or using the Eshwara platform (the "Platform"), you agree to be bound by these Terms of Use, all applicable laws, and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Platform. The materials contained in this Platform are protected by applicable copyright and trademark law.

2. Eligibility & Registration

To purchase fractional real estate co-ownership titles on Eshwara, you must be at least 18 years of age and capable of entering into legally binding contracts. During registration, you agree to provide accurate, current, and complete information, including KYC documentation (PAN card, Aadhaar, bank details) as required by financial regulations and SEBI guidelines. You are solely responsible for maintaining the confidentiality of your account credentials.

3. Fractional Ownership Structures

Eshwara acts as a technology-facilitated marketplace. Fractional ownership of real estate assets is facilitated through corporate Special Purpose Vehicles (SPVs), private trusts, or co-ownership deeds. Purchasing "co-ownership titles" represents a proportional beneficial interest in the underlying SPV or asset. All transactions, title deeds, and tenant leases are audited by independent trustees to ensure direct, secure interest.

4. Payments, Escrow & Wallet

All investment funds are handled via independent escrow accounts managed by SEBI-registered trustees (e.g., ICICI Trustee Services). Funds are only released to the seller upon successful completion of the asset's target funding and registration of the sale deed. Secondary market transactions, divestments, and payouts are processed via the user's secure digital wallet in accordance with regulatory lock-in periods.

5. Risk Disclosures & Yields

Real estate fractional ownership portfolios carry market, liquidity, tenant default, and capital loss risks. Yields (including target rental yields and projected appreciation rates) displayed on the Platform are illustrative, calculated based on current leases and historical performance, and do not guarantee future returns. Co-owners must review the specific property information, trust deeds, and risk prospectus before acquiring titles.

6. Prohibited Activities

You agree not to use the Platform to: (a) engage in any fraudulent activity, money laundering, or unauthorized financial transactions; (b) probe, scan, or test the vulnerability of the Platform; (c) bypass any security measures; (d) use any automated systems (bots, scrapers) to extract property data; or (e) transmit any malicious software or viruses.

7. Intellectual Property

All content, logos, designs, text, graphics, graphics files, databases, and software on the Eshwara Platform are the exclusive property of Eshwara Technologies Pvt. Ltd. or its licensors. You are granted a limited, non-exclusive, non-transferable license to access the Platform for personal, non-commercial investment activities only.

8. Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these terms or Platform transactions shall be subject to the exclusive jurisdiction of the competent courts of Mumbai, India.

Changes to Terms

We reserve the right to revise or modify these terms at any time. When updates are published, we will revise the "Last Updated" date at the top of this page. Your continued use of the Platform signifies acceptance of any updated terms.
